1. Premise and Acceptance
This document governs the conditions of use of the LifeComp Explorer portal (hereinafter "Portal"), accessible at lifecomp.explorerhub.eu, managed by IDCERT S.r.l. Societa Benefit (hereinafter "IDCERT" or "Operator"), headquartered in Italy.
Access to and use of the Portal constitutes full and unconditional acceptance of these Terms of Use. If the user does not intend to accept these terms, they are invited not to use the Portal.
2. Nature and Purpose of the Portal
The Portal is an interactive consultation tool for the LifeComp framework, published by the Joint Research Centre (JRC) of the European Commission. The Portal serves exclusively informational and educational purposes.
The Portal is NOT:
- An official service of the European Commission or JRC
- A certified competence assessment tool
- A professional consultancy service in educational, psychological or training fields
- A diagnostic or clinical tool
3. Intellectual Property
a) LifeComp Framework Content
The data, descriptions and structure of the LifeComp framework are the property of the European Commission / Joint Research Centre and are used under the Creative Commons Attribution 4.0 International (CC BY 4.0) license, as detailed on the Attribution page.
b) Original IDCERT Content
The editorial content, design, graphics, source code, adapted translations, interactive features (including the self-assessment), the logo and the brands "LifeComp Explorer" and "ExplorerHub" are the exclusive property of IDCERT S.r.l. and are protected by Italian, European and international copyright and intellectual property laws (Law 633/1941, Directive 2001/29/EC).
Reproduction, distribution, modification, reverse engineering, automated scraping or commercial reuse of such content without prior written authorisation from IDCERT is prohibited.
4. Permitted Use
The user is authorised to:
- Browse the Portal for personal, educational and non-commercial use
- Share links to Portal pages
- Download the self-assessment results image for personal use
The user is NOT authorised to:
- Use automated systems (bots, scrapers, crawlers) to access the Portal or extract content
- Copy, reproduce or distribute IDCERT's original content without authorisation
- Use the Portal or its content for commercial purposes without written agreement
- Attempt to compromise the security, integrity or availability of the Portal
- Present self-assessment results as official certification or professional evaluation
- Remove or alter copyright, license or content attribution notices
5. LifeComp Self-Assessment
The self-assessment tool available on the Portal is a personal self-reflection tool based on the LifeComp framework descriptors. The results:
- Have no scientific, diagnostic, clinical or certification value
- Do not constitute an official competence assessment
- Should not be used as the basis for educational, professional, medical or legal decisions
- Are generated solely from the user's responses
- Are associated with an anonymous session identifier and cannot be traced back to the user's identity
IDCERT disclaims all liability for improper use of self-assessment results.
6. Disclaimer of Warranties
The Portal and its content are provided "AS IS" and "AS AVAILABLE", without any warranty, express or implied, of any kind, including but not limited to:
- Warranties of accuracy, completeness or currency of content
- Warranties of fitness for a particular purpose
- Warranties of non-infringement of third-party rights
- Warranties of continuity, availability or error-free service
IDCERT endeavours to keep content as accurate and up-to-date as possible but cannot guarantee the absence of errors, omissions or inaccuracies.
7. Limitation of Liability
To the maximum extent permitted by applicable law, IDCERT S.r.l., its directors, employees, collaborators and partners shall in no event be liable for:
- Direct, indirect, incidental, consequential, punitive or special damages arising from the use or inability to use the Portal
- Loss of data, profits, opportunities or goodwill
- Damages arising from decisions made on the basis of Portal content or self-assessment results
- Damages arising from service interruptions, errors, viruses or malfunctions
- Damages arising from unauthorised access to systems or interception of communications
This limitation applies regardless of the legal theory on which the claim for damages is based (contract, tort, strict liability or otherwise).
8. Links to Third-Party Sites
The Portal may contain hyperlinks to third-party websites (e.g. European Commission, JRC, ExplorerHub, IDCERT). Such links are provided solely for the user's convenience. IDCERT does not control and is not responsible for the content, privacy policies or practices of such sites. Access to third-party sites is at the user's sole risk.
9. Amendments to the Terms
IDCERT reserves the right to modify these Terms of Use at any time. Modifications shall be effective from the moment of publication on the Portal. Continued use of the Portal after publication of modifications constitutes acceptance of the new terms. Previous versions are available in the Archive section.
10. Governing Law and Jurisdiction
These Terms of Use are governed by Italian law. For any dispute arising from the interpretation, validity or performance of these terms, the Court of Rome (Italy) shall have exclusive jurisdiction, without prejudice to the mandatory rights of the consumer under the Italian Consumer Code (Legislative Decree 206/2005).
